Murder accused gunned down in front court while escorted by cops


Peter Garcia who was shot dead while being escorted by police officers

Peter Garcia was in handcuffs, police officers at his side, on the compound of a court, with dozens of officers nearby, when he was shot dead by men mocking the State’s ability to protect.

Garcia had no chance to defend himself, and no one to defend him.

The police constables escorting him to the police station next door released their prisoner and ran after the first gunshot.

The policemen who responded to the shooting came long after the suspects were gone.

Acting Police Commissioner James Philbert said the police response to the killing would ’show criminals that we are in charge. Today we have lost some ground in the sense that criminals can be so boldface to do that. I want to promise the nation that we will find these men and bring them to justice in the quickest time’.

The suspects were free last night. The killing happened at 10.30 a.m. moments after Magistrate JoAnne Connor made a favourable ruling in Garcia’s case.

Garcia, who five months ago was regarded as Trinidad’s most wanted, was in court charged with wounding with intent to commit murder, and with the murder of Rio Claro businessman Simboonath Kumar.

On the murder charge, the State was told it had one last chance to come prepared, November 4, to begin the preliminary enquiry.

Garcia had already been discharged on two kidnapping charges.

When the gunshots sounded outside the door Magistrate Connor asked, ’Is that gunshots?’

A police officer ran in to announce the shooting. People began screaming and ran towards the Magistrates’ Chamber.

Magistrate Connor fled first. Those standing outside the courtroom-witnesses to the killing-ran into the courthouse.

No Court and Process officer was armed, the Express was told, because the Police Standing Orders do not allow for officers in contact with prisoners to carry firearms.

The killers used Uzi submachine guns. They fired on the police station before leaving. And despite a response that involved multiple search teams, tracker dogs, road blocks, and a helicopter hunt, the suspects vanished.

The killers had no problem getting onto the compound. The entrance to the courthouse is not guarded. Only at the courtroom door is a person searched.

Garcia’s attorney Jason Jackson, who heard the shots that killed his client, said, ’Government should consider more security of high risk prisoners and judicial officers. It is unfortunate that the country has gotten to this stage where there is no respect for law enforcement.’

The courthouse is being renovated, with a guard booth being constructed at the entrance with an extension to the main building for administrative staff.

The killers used the construction site as their guise. They dressed in steel tipped boots, hard hats and coveralls that hid their guns. No construction took place yesterday but no one appeared to have questioned the men who stood within the unfinished walls of the building and waited for almost two hours.

During Garcia’s initial court appearances, he was defended by heavily-armed officers who surrounded the courthouse.

Police said yesterday the two ’construction workers’ approached Garcia as he was being escorted from the court by two police officers and one of them pulled a gun and shot Garcia at point blank range.

The officers ran, and as Garcia fell, the second man stood over him and fired at least five times into his head and chest.

The men climbed a chain-linked fence on the south side of the court compound, ran through the grounds of the Rio Claro Anglican Church, and left the area in a silver coloured Nissan Almera car. A bank nearby closed its doors as people ran from the courthouse.

A crowd of hundreds returned later to ridicule the police. Among them was Garcia’s father, Harvey Huggins, who asked, ’How could my son get shoot in police hands. Don’t they supposed to protect him?’

Huggins said more people would die as a result of his son’s killing. Garcia’s handcuffs were removed before his body was taken away yesterday afternoon.

This must be some kind of joke...the statement by the COP Philbert...you admitting the criminals are in charge, makings promises to the public isn't going to solve anything...give the job to someone who can take charge and protect and serve the public...it's evident that you and your men are not up to par controlling the crime situation...this paragraph says it all. As i predicted , there will come a time when police will have to fear for their lives because the country will be ruled by these thugs, this should be the last warning, remove that incompetent minister of national security, make Philbert the commissioner of police and stop him from acting , untie his hands and allow him to do his job , declare war on the lawless and criminal misfits of our society. To Mr commissioner, i do mean war in the true sense of the word, there will be no sleep , no place to hide , you should leave no stone unturned in the relentless effort to establish law and order , comply or die is the only way for all criminals. It must be with a relentless passion that you hunt these animals and eradicate the country of the unlawful tyrants, start by a country wide manhunt, all law enforcement agencies working day and night , using all human and artificial intelligence to your disposal and bring these brazen criminals to justice, preferably DEAD , yes i said it, you can't.

I am sure if we go back to the Police standing orders we would find that they were initially initiated back in the times of Tony May, then Commissioner of Police. We are talking forty odd years ago. The reason that procedure was used was to prevent prisoners from snatching weapons from police while being escorted. What modern Police do in the civilized world is they have a chain and hand cuff mechanism whereby the escorted prisoner has handcuffs on their feet, this is then connected to their waist and then to their wrist which then immobilize the escorted prisoner because their arms are also restricted from making longing motions, instead it keep their arms restricted to their sides. I am sure they are going to change this standing procedure now, anyone taking bets? The areas around all Court Houses should be considered sensitive so there should at least have hidden mounted surveillance cameras that would have recorded all the activity automatically. But folks you see these things have to transpire because we are forever a Nation doing things like a dog trying to catch its tail. Like the fable of the Dutch boy running around plugging the dyke every time water leaks. Smelter Plants and stadiums have more priority. These things are above the wisdom of your Minister of National Security, and only when these things occur you will soon be hearing some mamby pamby lame brain excuse once again. Stay tuned for a Lip service message coming from him soon. The judge needs to say two Hail Mary’s tonight before she goes to bed. The Commissioner of Police needs to stop that rhetoric; he himself starts to sound like Martin Joseph with his predictions!! We are not quite yet a Banana Republic. Democracy works at its best when the accused has the opportunity to be found innocent or guilty by a jury of his pairs. Going out and shooting people and then telling the public that “We got them” is what Idi Amin, Papa Doc, Robert Mugabe, Bokassa, and believe it or not Adolf Hitler used to allow under their leadership. They should be a Police Service and not executioners, which is the job for hang man. Wow...not only is one of the biggest roach problem dead...they were bold face enough to kill him in front of a court room. As far as his father goes, he needs to shut the hell up...they did the country a favor. The police on the other hand, are a bunch idiots who can't protect or find criminal who commits a murder right in front of them...lol.

WOW! I never thought it could get worse. This is the worst. This is SCANDALOUS. The fact that criminals are acting with such impunity doesn't say much for crime prevention in T&T. It appears that the criminals think they are untouchable. Why do they think that?

I am appaul at what is happening in Trinidad a country with great potential within this region. Why are criminals operating without fear and committing crime at will. there were two studies done recently where the government spent millions for the recommendations. I will ask the question now are these recommendations beings acted upon? Honestly I believed from a security point a view that the recommendations are worthless and will do nothing to reduce the incidence of crime. I recommend that the government rethink its crime fighting tatics and lets see a new approach. What happen yesterday should never happen you see that in movies I am very worried about the safety of our judicial workers. Mr. Commissioner your comments will be closely watch if the men are not caught you should do the best thing and resign.

According to the article, the father stated that more people would die as a result of his son's killing, well it seems like he knows who did it and why they did so. I don't blame the officers for running for cover, hey, these officers were unarmed, and on top of that, why would they want to risk their life for someone who has a rap sheet as long as the length of the Island he lived in?

Well, there you go: Another page in the book of horrors that is life in "Sweet TnT." Those fleeing police officers escorting the prisoner really are "Trini To De Bone." They ran like cowards and left this hand-cuffed murderer to be cut down like a dog in the street. And then a crowd of 'hundreds' later returned to ridicule the police. This just shows how much confidence the general public has in this police force: NONE! Trinidad and Tobago truly is a basket case of a country. But don't fret: Allyuh still have that Vision 2020 thing right? And tall, empty buildings too. Steups!!!

It is not the police's responsiblity to protect criminals. This article has implied that the police should have provided additional protection for this person. I think it would be a WASTE of the police's already stretched resorces when focus should be on law abiding citizens.

This is obviously a professional hit, done by people who knew exactly what the were doing. Disguises, limited collateral damage, no witnesses shot by stray bullets, a knowlege of the vulnerabilities of courthouse system and a clean get away. If only the legal system could work as smoothly as our local assasins. Rest assured, these men will not be caught, they are obviously light years ahead of our local police force. Trinidad needs to stop spending money on ferries and start training its police officers, and increasing salaries to attract a brighter set.

Peter Garcia was a well loved person he was the "vigilante" that everybody loved and whom every body loved to hate. It is so sad that he died in police hands. The people of Trinidad and Tobago need to act now before it happens to your families who are still innocent until proven guilty. The police need to wake up stop being in a daze you are not machines you are human beings of an elite force you need to think and act carefully. Be alert and aware of everything that is happening to you. Don't think of the person you are transporting as a criminal you are in no position to pass judgment on these human beings. Imagine if the bullets did not hit Peter and it had hit an officer i am positive that the criminals would have been caught and brought to justice or even eliminated from society. These criminals have zero respect for the Trinidad and Tobago Police Service (TTPS). We now have people in police custody being executed literally right before the police nose. What are regular citizens to think if we can not even rely on the police to protect us? And this is not an isolated incident. Earlier this year, a woman was shot to death in a police station compound in Diego Martin. This is definitely not the same TTPS that Randy Bouroughs served in. They are like toothless and clawless tigers.

"The killers had no problem getting onto the compound"....that is part of the problem. The life of this young Man may not have been the most exemplary, but he was a Human Being non- the- less. The young Men and Women of Trinidad & Tobago need to wake up and realize that this continued violent and irresponsible behavior is surely going to land them on a slab in the mortuary. Killing has become the favorite pass time for many, time to take up new hobbies, turn all that anger and negativity into something positive, perhaps an education or developing some self respect. When are we going to get "real" police? This example of what passes for police is what has citizens at home and abroad despairing for the future of the country. The policemen escorting the prisoner "ran" away. Now I know that they were facing UZIs but they gave not a thought to protecting the prisoner nor the public present in front of the courthouse. The gunmen had time to escape from the scene without any fear of the police present. Mr. Commissioner, you need to discipline the two escorts with a view to getting them out of the service. Who in their right mind would standup when there is an ambush with gun shots. Hence the word ambush, that means they were taken by suprise people, if they did not know where the shots were coming from at first they should not be stupid enough to stand around and get shot, whoever saying the police should not have run for their lives, please, please please, put yourself in their shoes and tell me if you would not high tail it too. Of course a man is innocent until proven guilty but if Garcia was so innocent why was he hiding in the forest before he gave himself up to the police leading up to this court date. Of course his father and other relatives would ridicule the police, if his father was escorting him to the court, he himself would not have been able to protect his son, he probably would have been the first one running for his life.

When asked why I won't consider coming back to Trinidad to retire or for vacation, I always refer to what seems as the utter madness and breakdown of society as it relates to the ability of the law enforcement arm of the government to protect it's citizens. I live in a town in Georgia, just north of Jacksonville, Florida and while crime is every where, I feel safe enough to walk or drive the streets at any hour of the day or night. More and more my yearning to return to Trinidad even for a vacation or to see family diminishes rapidly when I read what's happening to a once beautiful and peaceful land. It does not escape me that for such a small island the police cannot or choose not to know who is responsible for all this carnage, crime and innocent loss of life. While this man was due his day in court and hopefully innocent until proven guilty, it appears that too many criminals are allowed to walk about without any compunction or empathy as to their victims or families. Give the law abiding population the protection and justice they lawfully deserve. Allow all law abiding citizens who apply for legal arms to protect themselves the right to do so. Criminals can and will always break the law and gain access to illegal arms, However when they have to guess if the next person they intend to victimize has a gun to protect himself, family or property they will have to think more than twice before they carry out their crime. Violence may increase for a while but it will eventually subside as criminals are dispatched to meet their maker and others will think twice about hurrying to the here after. God is a just God and we'll all have to give an account of our actions, CRIMINALS AND POLITICIANS ALIKE.

It is a shame that my cousin had to die this way. It is a family feud going on and many more is going to die as a result of Peter`s death. I hope that when time come the police will not say the statments they got from him after he gave himself up in San Fernando are missing. There are alot of police officers involve in the GARCIA`S FEUD and they know exactly who killed him. May his soul rest in peace just like the others.

This is not how they serve their motto that states to protect and serve. Our police system is in a mess. I would wish that the police commissioner look into tightening the police system within Trinidad and Tobago. Change should begin inside the POlice System.

I reently returned to Trinidad a little over 2 months, and while I've been hearing day-in and day-out dismal news where crime is concerned, this is the epitome of "high class slackness!!!" First off, we have the "accused" who is proven innocent until found guilty, being treated in opposite manner- tried prior to his day in court. Then there's those who clearly have no regard for the law, the magistrate and well- this country. When you can look someone in their face and mind you, in the company of officers, and open fire, you know something is drastically wrong. The system needs a thorough revamping from the head, straight down. It's not enough to escort prisoners to and from their designated locations, but they have to be able to "protect and serve" ALL!!! I understand these officers had no weapons to defend the prisoner or themselves, but you mean to tell me, they don't have some skill or training that would have enabled them the possibility to do somethin other than to play "hide and seek". This system needs to take a stock of itself and the training of it's officers, before everyone jumps on the bandwagon of tagged.

Where are the old hard core Randolph Boroughs police officers? I cannot believe that no was was suspicious enough to inquire about the men wearing construction gear when there was no work. The police officer fled. They were unarmed. The bandits have taken over. This is really frightening.

Thank you,it should not be the police responsiblity to protect those criminials. at one time we all belived innocent untill proven guilty ,but these day the police hands are tied they are catching the criminals but what happens when they go to court?i feel very sad that this is happening in our sweet tnt, but right now any way we can get rid of the criminials do it, especially the repeat offenders that feel they are above the law. bandits do get shoot by bandits,ent! in any western.

Sorry...I have no sympathy for criminals. This in itself is justice. Don't act that the victim was a victim...he was a murderous felon. You live by the sword... The cops only pretending now to look for his executioners - when they're saying, "one down...more to go." Take solace in the fact that no more tax payers dollars will be spent to fund his trials. Yes he was set up, ambushed and assassinated.But why?The killers or who ever they were working for went thru great lenghts to shut him up.Peter Garcia said he never killed nobody but maybe he knew who did.And tow comments sunk in.One is that this is a family feud and did he give the police the info he had before he died and both that writer and his father stating that many more will die because of his death.Did this man belong to some kind of crime family?Were the police involved and aware that there would be a hit in front of the Rio Claro Court House with a police station next door?Even in the westerns the Sheriff escorting a prisoner would have his gun around his waist.Isn't it a deterrent against crime to have police officers and prison officers armed?Shouldn't police officers carry their guns whether they are on duty or not in light of the high crime rate in the country?And I never hear anything about under cover cops?Those men were dressed as construction workers and because of the weather no work was going on and not one officer found this suspicious.The report ssid that they were there for a while just hanging around smoking cigarettes and that their faces were not hidden.Don't tell me that they don't have security cameras outside the Court House? This was a Hit Mafia Style.Do they have ballistics to know if the gun is really those used by the Armed Forces?The killer stood and again fired five shots to the head and body.That takes time.Couldn't at least one police officer try to shoot at him while he was finishing the job?He must have been a paid assassin because he wanted to collect his pay and the order must have been kill him!
