Repeat offenders behind crime spree
Joseph: Acquittals, then more murders

There is ’mounting evidence’ to suggest that people on trials who secure their freedom by witness intimidation, are the same ones who go back to commit more murders and therefore contribute to the upsurge in crime.

Minister of National Security Martin Joseph told the Senate yesterday that law enforcement was reasonably confident that there is a strong correlation between the release of people acquitted of murder (in circumstances where the main witness changed his testimony) and a rise in the homicide rate, especially in relation to gang-related homicides.

Speaking in the debate on the Evidence Amendment bill, Joseph said between January 2004 and this year some 61 matters have been dismissed in the courts because the main witnesses refused to give evidence, ’forgot’ or reneged and retracted their earlier statements.

Pointing to the correlation between people winning their freedom on the basis of witnesses changing their testimony and the increase in crime, Joseph said five such people were acquitted of murder and released in January and by February there was a spike in murders to 56. He said four people were so acquitted of murder in June and there were 47 murders for that month. And seven people were acquitted of murder between July and August and in September there was another upsurge-55 murders.

The Minister said there was significant impact to having these suspects (who are acquitted) on the streets. ’These people are responsible for multiple homicides on a very regular basis,’ he said, adding: ’In one of the cases which we are still prosecuting, one of the accused is believed to be responsible for 13 killings in the six months prior to the three (murders), for which he is currently charged. Were he to be released due to intimidation of the witness, there is nothing to suggest that he would not continue to exact revenge in all involved in his case and continue with killing spree’.

In underscoring the importance of the Evidence Amendment bill, which aims at dealing with witness tampering and witness intimidation, Joseph said gang-related homicides by their very nature were more difficult to detect, using scientific evidence, because of the lack of contact between shooter and victim. He said without exception these investigations are heavily reliant on witness evidence. In this regard law enforcement officers are required to invest considerable time in witness care and in building up a trusting relationship with families and witnesses. Since, he said, in general, witnesses are family members of the deceased who are terrified at the prospect of giving evidence.

Joseph said the homicide investigative unit is currently achieving a 36 per cent detection rate on the 55 gang-related homicides for 2009.

’It is estimated that this detection rate would have risen to over 50 per cent had this legislation been in place,’ he said. He added that it was estimated that approximately 50 witnesses with relevant evidence have been lost due to fear of violence or intimidation.

’It is very difficult to estimate the impact of the legislation should it be passed, but our senior investigating officers believe that there are 17 potential offenders who could have been brought to justice if further measures were put in place to assist witnesses in relation to the fear of intimidation’, he said.

Joseph, however, stressed that the legislation was not a ’silver bullet.’

He said that there was a need for law enforcement to step up the way it did investigations. He said between January 2006 and October 2009, some 2,299 officers received various evidence-based training courses. These course included forensic awareness, crime scene management, investigative interviewing, finger-print evidence recovery and recording, digital photography, court familiarisation and recording statements. Training was provided by the Specialist Crime Academy of the Special Anti-Crime Unit. See Page 7.

Mr Joseph we know that sir and the bad boys knows that to. The entire system need changing sir, remember independence gave us the right to change our laws. Somthing should be done,If the Government can't then who could, or would. It's the job of the law which is controlled by Gov't.
Finally peace on earth for all men and women too! Posted: 2009-11-02 10:07:00 PM
What an earth shattering discovery: Repeat offenders behind crime spree. I nominate him for a Nobel prize.
News? Posted: 2009-11-03 03:33:00 AM
It amazes me that the man on the street sees these things before these ministers. It is certainly not news to folks who have had their eyes on the Trinidad scene. It took Martin all this time to see that? I guess he does not know too that the prisons are like crime universities. When police have to duck for cover and lawlessness reaches the doors of the court, who he felt committing the crime? Is real jokers in the parliament.
Really, really really old news Posted: 2009-11-02 11:30:00 PM
While an attempt is being made to add to the laws in an effort to battle crime, we know that it is the criminals who are out on bail who are wrecking havoc in the society. The problem is, if we know that a criminal will walk out on bail in any case, what is the incentive to give a recorded statement?
Repeat offenders behind crime spree Posted: 2009-11-03 06:33:00 AM
It does not take genius to fugure out that if you could get away it all the time, why stop? This is a must bill for crime fighting in T&T. If witnesses do not testify, the criminals don't fry. This amendment will even help save the lives of the witnesses, as there will be no sense in killing the witness as his already recorded testimony will do in his stead. Let's pass this bill and get going!

Well Mr. Joseph, what do you intend to do about this situation. Now that you have found out the reason why crimes are continuing at an alarming rate, and you being the Minister of National Security, the ball is in your court to make recommendations and do something about it. Crime is out of hand in T&T.
Repeat and Repent! Posted: 2009-11-03 07:19:00 AM
Ladies and Gentlemen, Does this mean that we can all go to sleep tonight breathing a sigh of relief, now that the Police have an idea of who is comitting the crime in our Country? Are these fellas crazy or what!!!??? Mr. Joseph makes it sound like the Police Force came to this conclusion after much intense research and detective work...NOT! This was a case of reading the statistics! If our highly untrained Police Officers would actually leave the Police Station occasionally to do some field work, we may have a better handle on things. This sounds like complacency on the part of Mr. Joseph, should we all throw our hands up in the air and give up at this point??? God put a hand!!! Certant Omnes.
Well obviuosly Posted: 2009-11-03 07:22:00 AM
Did the minister just figure this out? If criminals are not locked up, they will do more crime! It is well known that many criminals return to crime after they have done their time; so what happens with those who have esacped prosecution or conviction?
Death penalty Posted: 2009-11-03 06:19:00 AM
Please reinstate the death penalty, maybe that should help. Why is the death penalty not being carried out? What is the hold up?
The Honourable Bluff-Master Posted: 2009-11-03 03:21:00 AM
It is sad and disturbing to know that much time, money, brain power and effort is spent for the Honourable and Learned Minister Martin Joseph to tell the Nation that repeated offenders are responsible for the crime spree. The Nation already knows this. Our tax payers' money is being spent on this Learned Minister to tell us what we already know and experience. I am sure his next public announcement in a few months would be "The Government has conducted many studies and have found that crime is a social problem" or "The Government has sent us to Conferences (also called Holidays) all over the world to tell the Nation that all the shootings are inflicted by Guns". Sit and reflect, when you go to sleep, that we have vested our safety and/or security via the Social Contract in this very competent Honourable Minister who bluffs for a living. Shankar Bidaisee
WAKE-UP AND GO HOME MR.INSECURITY MINISTER Posted: 2009-11-03 10:21:00 AM
You must be really a comedian Mr.Joseph.It took you over ten years to realize this? What did the foreign experts take all that money for? It's apparent, based upon your new discovery that you were robbed,by them.Ordinary citizens in China and any other part of the world could have told you that, for no cost. You could have paid "Robo Cop" for this information. Please Mr.Minister, retire before you get kidnap,by persons unknown to you and the Cabinet.I just cannot believe what you are now revealing. How does it feel to get "bright"overnight.Great job Sir,Mr International P.M.must be elated to tell the country this. I must sing in a tent this Carnival,it will be a great opportunity for me to be crown Monarch(so many options to choose from to sing).Aubert Modeste
The light bulb just went on, huh! Posted: 2009-11-03 11:39:00 AM
Mr. Joseph, you are a senior cop! Who enlightened you, Sir. A 1st grader could have told you that since the first criminal was given bail and allowed to kill again, and again, AND AGAIN. Hip, Hip, Hooray! Mr. Joseph just realized that criminals are the repeat offenders. Brenda. Edmonds, WA
Look in the mirror Posted: 2009-11-03 06:52:00 AM
All the comments about how silly Mr Joseph is fail to bring about the solution. First we must ID the problem. The voters of Trinidad and Tobago elected these men and women to run this country and now we are calling them names. Please look in the mirror and berate the person you see in the mirror. You elected them so u reap what you sow. Stop complaining and start making changes. elect people who can do the job and not the party or the race and finally keep the fire to their feet so they have to earn your trust. Dont ask the Lord to help you. Do IT yourself.
Repeat offenders Posted: 2009-11-03 11:55:00 AM
While it is easy to trivialize and critique the efforts made by individuals to bring the bill this far, long overdue/welcome as it may be. Let us hope that the legislature has the good sense to move forward on this bill and include in it the ability to adjust where necessary as the perptrators of crime adapt to the new circumstances. Also let it not take as long as the southern highway bypass, to get through the house. If it should do so, citizens! please remember the indiviuals at election time...... And in all of this let us keep in mind the ages of these perpetrators, who seem to choose crime over free education, destruction of social behaviours, over the building there off. Basically the gun over the pen. There needs to be efforts or a strengthing off to counteract the roots of this type of thinking..... Together we will aspire and together it will be achieved.
MR. JOSEPH Posted: 2009-11-03 07:06:00 AM
Frist Mr Joseph you have to protect witness because nobody will come forward if they know their live is in danger that one. Two just like LA. murder and crime was very high. They started the three strike and you lock up for life. That scare most criminal. Now Compton, Oakland crime is way down murder rate don't even reach 150 and Trinidad could fit in LA. about 30 times something to look into. Airborne Trini
Please resigned Posted: 2009-11-03 12:08:00 AM
Mr. Minister, why don't you do yourself and the people of Trinidad & Tobago a favour and resigned from public office.
Minister Joseph! Posted: 2009-11-03 2:37:00 PM
Rather than soley depend on State Witnesses to gain a prosecution, a competent police force would also employ alternative methods - forensic etc. Are we so backward that we do not have these means and if not why not? Minister Joseph, we are waiting to hear from you.
Not a Clue Posted: 2009-11-03 2:56:00 PM
What is evident from Minister's Joseph statement in front of Parliament is that he has no clue what is causing the increase in crime and thus no clue on how to decrease it!
